Wathika’s poll case to be decided


The fate of Mr Dick Wathika as Makadara MP will be known on Friday.

In a judgment to be delivered on Friday morning by Lady Justice Kalpana Rawal, Mr Wathika will know whether he will continue to represent the residents of Makadara in the 10th Parliament.

Mr Wathika's election was challenged by former MP Reuben Ndolo, who cited numerous irregularities in the 2007 polls.

Mr Ndolo had asked the judge to nullify the election, claiming that officials of the defunct Electoral Commission of Kenya (ECK) colluded to rig the polls by orchestrating his arrest on December 28, 2007.

However, Mr Wathika has maintained that the allegations had not been proven.

Former Mugirango South MP Omingo Magara will also be waiting for a verdict from the highest court in the land after he challenged a ruling that saw him lose his parliamentary seat.

In another petition, a voter has challenged the dismissal of a petition disputing the election of Mr Walter Nyambati as Kitutu Masaba MP.

Mr Justus Mungumbu Omiti moved to the Court of Appeal after the petition was rejected on a technicality.

The High Court, sitting in Kisumu, ruled that there was no evidence of any attempts of personal service before the stipulated date of January 17, 2008. The ruling will be made next Friday.

And a former Wajir district election coordinator on Thursday disputed claims that recruitment of election officials in Wajir South was influenced by the area MP.

Professionally

Dismissing allegations that Mr Abdirahman Ali Hassan influenced the appointments through his sister, Rukia, Mr Issa Galole told an election court that the interviews were conducted professionally.

Mr Galole was giving evidence in a petition filed by ODM-K's Mahamud Muhumed Sirat, who is challenging the election of Mr Hassan of Kanu. The hearing continues on Friday.
